0. HUMANS WELCOME
This document is intended to be human-readable (well, mostly), and as a user
of Coderific, you're encouraged to read it and comment on it. After all, it's
a community-driven site.
1. ACCEPTANCE OF TERMS
Coderific provides a collection of online resources, including employer
ratings and discussion forums (referred to hereafter as "the Service") subject
to the following Terms of Service ("TOS"). By using the Service in any way,
even if that only involves printing it out for wallpaper, you are agreeing to
comply with the TOS. If for some unfathomable reason you object to any term or
condition of the TOS, object to any subsequent modifications to the TOS,
become dissatisfied with Coderific in any way, or break out in a rash after
using Coderific, your only recourse is to immediately close your web browser,
discontinue use of Coderific, and sit and contemplate how you will go on
living without the soul-filling glory that is Coderific.
2. MODIFICATIONS OF THIS AGREEMENT
Coderific reserves the right, at our sole discretion, to alter these terms and
conditions at any time between now and the heat-death of the universe. If and
when we decide to do that, such modifications become effective the very
nanosecond they're posted. It would be prudent to review this agreement on a
regular basis to keep yourself apprised of any changes. We recommend reading
the TOS once after each meal, and again after any sweets. You can find the

3. CONTENT
You understand that all ratings, postings, text, ASCII art, or other materials
("Content") posted on, transmitted through, or linked from the Service, are
the sole responsibility of the person who provided the Content. You, dear
user, are entirely responsible for each individual item of Content that you
post, submit or otherwise make available via the Service. You understand, and
should realize without having to be told, that Coderific does not control, and
is not responsible for Content made available through the Service, and that by
using the Service, you may be exposed to Content that is offensive, indecent,
inaccurate, misleading, devoid of all literary merit, marked by a disturbing
lack of punctuation, rife with factual errors, or otherwise objectionable.
Furthermore, Content available through the Service may contain links to other
websites, which are completely independent of Coderific. This distinction
should be readily apparent because most external sites look like they've at
least had a cursory once-over by a graphic artist. Coderific makes no
representation or warranty as to the accuracy, completeness, authenticity, or
seaworthiness of the information contained in any such site. Your linking to
any other websites is at your own risk. You agree that under no circumstances
will Coderific be liable in any way for any Content or for any loss or damage
of any kind incurred as a result of the use of any Content posted, submitted
or otherwise made available via the Service. You acknowledge that Coderific
does not pre-screen or approve Content, but that Coderific shall have the
right (but not the obligation) in its sole discretion to refuse, delete or
move any Content that is available via the Service, for violating the letter
or spirit of the TOS or for any other reason.
4. PRIVACY
Protecting your privacy and anonymity as you use Coderific is of the utmost
importance, and you have a right to know exactly how that is accomplished.
Coderific will make reasonable efforts to help you maintain your privacy and
anonymity, including but not limited to frequent log rotation, hiding of email
addresses and IP addresses, and general sneaking about and looking suspicious
on your behalf. However, ultimately protecting your own privacy and anonymity
is up to you, and if your cover gets blown, then it's your own damned fault.
5. WHAT INFORMATION IS GATHERED
The following is a list of information logged as you use Coderific:
* the numerical IP address of your computer
* your web browser and operating system
* the URL (web address) of the site that linked you directly to this site
* the web pages you access on Coderific
* the date and time you access each Coderific page
This log information is kept for no more than 24 hours before it is
automatically deleted. Coderific does not programmatically correlate this
information with specific Coderific user accounts.
Additionally, when you are logged into your Coderific account, Coderific sends
a session cookie to your web browser that lasts a few days before expiration.
The cookie also expires when you manually logout of your account.
Coderific stores account information that you enter when you sign up for an
account, and this information is stored indefinitely. This includes:
* your username
* a unique user id
* a cryptographic hash of your password
* your email address, if provided
Coderific also stores all contents of the discussion forum posts, employer
ratings, and employer descriptions you enter, including past revisions. These
contents are stored indefinitely.
Your actual password is sent to the Coderific server whenever you login, but
it is immediately discarded and not stored. At this time, HTTPS encryption is
not used to protect your password in transit.
If you send email or otherwise submit information to Coderific, the
information you send is stored indefinitely.
Note that deleted information may continue to persist on backup media.
6. HOW YOUR INFORMATION IS USED
The log information gathered as you browse the site is used for debugging
problems and determining how people use the site in order to improve Coderific
for everyone. As mentioned above, this log information is automatically
deleted within 24 hours. The session cookie allows you to remain logged in to
your account as you use the site.
The contents of your posts, ratings, and descriptions are made publicly
available on the web site for everyone to read.
Coderific developers will be able to see your username, user id, password hash
(but not your actual password), and email address (if provided). This is used
for debugging problems and diagnosing account problems.
If you provide an email address, it will only be used for resetting your
password or contacting you about problems with your account. It will
absolutely not be used for advertising Coderific, adding you to mailing lists,
sending you spam, or contacting you for any reason other than a password reset
or account problem. However if you do contact Coderific by email (such as with
a support request), you will receive a response at your email address and
possibly some helpful follow-up emails.
7. WHEN YOUR INFORMATION IS DISCLOSED
Your log information is not shared with anyone, except as required by law.

Your posts, ratings, and descriptions are made public as soon as you post
them. Only the most recent version of the content is made available publicly,
so if you update a particular post, previous revisions will not be shown.
None of your private account information, such as your email address, will
ever be shared with anyone, except as required by law. If you choose to post
anonymously, then your username will be hidden from other Coderific users. If
you do not choose to post anonymously, then your username will be displayed
along with your posts.
If required by law, such as pursuant to a subpoena or other judicial or
administrative order, Coderific will share your information with law
enforcement or appropriate legal representatives. If this does occur,
Coderific will attempt to provide you with notice unless prohibited to do so.
This notice may be sent by email if you have provided Coderific with your
email address, or it may be posted publicly on the Coderific web site.
If you are particularly concerned about your anonymity, it is recommended that
you do not enter an email address, so that if Coderific is subpoenaed for that
information, your email address cannot be used to identify you.
8. HOW TO UPDATE OR REMOVE YOUR INFORMATION
If you would like Coderific to update, correct, or remove your information
that has been gathered, please send an email with your request.
9. CONDUCT
You agree not to post, submit, or otherwise make available Content:
a) that is unlawful, threatening, abusive, harassing, libelous, or just plain
mean;
b) that impersonates any person or entity, including, but not limited to, a
Coderific developer or user, or falsely states or otherwise misrepresents your
affiliation with a person or entity;
c) that includes personal or identifying information about another person
without that person's explicit consent, or otherwise invades another's privacy;
d) that is false, deceptive, misleading, deceitful, or misinformative;
e) that infringes any patent, trademark, copyright, secret handshake or other
proprietary rights of any party, or Content that you do not have a right to
make available under any law or under contractual, fiduciary, or marital
relationships;
f) that constitutes or contains any form of advertising or solicitation; or
g) that disrupts the normal flow of dialogue with an excessive amount of
Content (flooding attack) to the Service, or that otherwise negatively
affects other users' ability to use the Service
Furthermore, you agree not to post, submit, or otherwise make available an
employer rating unless:
a) you are a current or former employee/contractor of the employer being rated;
b) you have worked in a software development capacity for that employer; and
c) you have written machine-readable program source code for that employer
If you have only interviewed at a particular employer, then please don't
post a rating. Instead, you can post in the discussion forum for that
employer.
10. LIMITATIONS ON SERVICE
You acknowledge that Coderific may establish limits concerning use of the
Service, because unfortunately we don't have infinite resources. These limits
may involve the length of time that we retain Content on the Service, the
number of items or size of Content that you may post, and the frequency with
which you may access the Service. You agree that Coderific has no
responsibility or liability for the deletion or failure to store any Content
maintained or transmitted by the Service. You acknowledge that Coderific
reserves the right at any time to modify or discontinue the Service (or any
part thereof) with or without notice, and that Coderific shall not be liable
to you or to any third party for any modification, suspension or
discontinuance of the Service.
11. TERMINATION OF SERVICE
You agree that Coderific, in its sole discretion, has the right (but not the
obligation) to delete or deactivate your account, block your email or IP
address, drop every third packet you send to the Service, or otherwise
terminate your access to or use of the Service (or any part thereof),
immediately and without notice, and remove and discard any Content within the
Service, for any reason, including, without limitation, if Coderific believes
that you have acted inconsistently with the letter or spirit of the TOS.
Further, you agree that Coderific shall not be liable to you or any
third-party for any termination of your access to the Service. Further, you
agree not to attempt to use the Service after said termination.
12. PROPRIETARY RIGHTS
Although Coderific does not claim ownership of content that its users post, by
posting Content to any public area of the Service, you automatically grant,
and you represent and warrant that you have the right to grant, to Coderific
an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to
use, copy, perform, display, distribute, and make wallpaper out of said
Content and to prepare derivative works of, or incorporate into other works,
said Content, and to grant and authorize sublicenses (through multiple tiers)
of the foregoing.
13. DISCLAIMER OF WARRANTIES
THERE IS NO WARRANTY FOR THE CODERIFIC SERVICE, TO THE EXTENT PERMITTED BY
APPLICABLE LAW. THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND,
EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED
WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. TO THE
FULLEST EXTENT PERMITTED BY LAW, CODERIFIC DISCLAIMS ANY WARRANTIES FOR THE
SECURITY, RELIABILITY, TIMELINESS, ACCURACY, AND SUCTION PERFORMANCE OF THE
SERVICE.
14. LIMITATIONS OF LIABILITY
IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW SHALL CODERIFIC BE LIABLE TO YOU
FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL, CONSEQUENTIAL,
CRITICAL, OR QUAD DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE
SERVICE (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED
INACCURATE OR LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR ANY DAMAGE ARISING
FROM INFORMATION OR ADVICE RECEIVED THROUGH THE SERVICE), EVEN IF SUCH HOLDER
OR OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. DAMN CAPS
LOCK KEY.
15. INDEMNITY
You agree to indemnify and hold Coderific harmless from any claim or demand,
including reasonable attorney fees and court costs, made by any third party
due to or arising out of Content you post, submit or make available through
the Service, your use of the Service, your violation of the TOS, your breach
of any of the representations and warranties herein, or your violation of any
rights of another.
16. YET MORE LEGALESE
The TOS constitute the entire agreement between you and Coderific and govern
your use of the Service, superseding any prior agreements between you and
Coderific. The TOS and the relationship between you and Coderific shall be
governed by the laws of the State of Washington without regard to its conflict
of law provisions. You and Coderific agree to submit to the personal and
exclusive jurisdiction of the courts located within Seattle, Washington. BYOL
(Bring Your Own Latte). The failure of Coderific to exercise or enforce any
right or provision of the TOS shall not constitute a waiver of such right or
provision. If any provision of the TOS is found by a court of competent
jurisdiction to be invalid, the parties nevertheless agree that the court
should endeavor to give effect to the parties' intentions as reflected in the
provision, and the other provisions of the TOS remain in full force and
effect.
17. VIOLATION OF TERMS
Please report any violations of the TOS by using the flagging feature on the
Content in question. Content that is flagged by a sufficient number of users
will be automatically removed from the Service.
18. SOURCE CODE
The Coderific machine-readable program source code that runs the Service is
available under the terms of the GNU General Public License, which defines how
you may distribute the source code. This TOS does not impose any further
restrictions on your use or distribution of the source code. The TOS only
deals with your use of the Service itself.
